Aunque la democracia ha sido concebida como una forma de gobierno, actualmente es posible definirla como un derecho fundamental. Sin embargo, es pertinente analizar si se han otorgado garantías idóneas a la democracia como derecho fundamental, para preservar el ejercicio de este derecho. En primera instancia, se analizará el derecho fundamental a la democracia, para posteriormente identificar las garantías que protegen este derecho, con el fin de construir criterios que permitan valorar su idoneidad, a partir de casos en los que se han aplicado distintos mecanismos de protección.
Lo anterior se hará a través de una valoración argumentativa y desde la teoría de los derechos fundamentales, como categoría de derechos de rango superior que dan sustento al modelo mismo de Estado.
Abstract
Although democracy has been conceived as a form of government, it is now possible to define it as a fundamental right. However, it is pertinent to analyze whether suitable guarantees have been granted democracy as a fundamental right, in order to preserve the exercise of this right. In the first instance, the fundamental right to democracy will be analyzed, in order to identify
the guarantees that protect it, with the purpose of constructing criteria that allow assessing their suitability, from cases in which different protection mechanisms have been applied. This will be done through an argumentative assessment and from the theory of fundamental rights, as a category of higher-ranking rights that support the State model itself.
