Los Vacíos Legales en la Legislación Deportiva para Adelantar las Impugnaciones en Contra de los Organismos Deportivos que Hacen Parte del Sistema Nacional del Deporte

Abstract

The functions of Inspection, surveillance and control of sports organizations were delegated by the President of the Republic in accordance with the provisions of article 211 of the Political Constitution of Colombia, in the Ministry of Sports in accordance with the provisions of the Sports Law, Law 181 of 1995.

Regarding the Sports Law and its regulatory decrees, it can be seen that it urgently requires a change and for this reason in recent years the Ministry of Sports has tried on three occasions to reform said law, without any of these attempts have prospered, there are currently legal gaps in sports legislation, which makes it difficult to exercise the functions of inspection, surveillance and control by the state to sports organizations, for this reason this projective work proposes a bill that contributes to overcome the normative vices of sports legislation and in this way better control can be exercised over the organisms, having a positive impact on Colombian athletes and sports.

It is important to highlight that although the Ministry has tried to reform the Law, on no occasion has the issue of the challenge process of the assemblies and meetings of the administrative body of sports organizations been included, so this is an innovative work.
