Resumen
La inquietud que despierta la contratación electrónica y la firma que se
disponga en ella, es un tema que aún no tiene generalizado el conocimiento
en las entidades del Estado, máxime, si la pesquisa cuantitativa se desarrolla
en las entidades territoriales; por ello, es relevante analizar, desde una
perspectiva cualitativa en este artículo, las vicisitudes que pueda conllevar la
firma en la contratación electrónica, desde el contexto jurídico de la firma
electrónica nacida de las Naciones Unidas con la Ley Modelo, que no solo
normativiza la utilización de la firma electrónica, sino que trae la directriz para
que ella sea incorporada al derecho interno de los estados; así también, se
dilucidará acerca de la firma digital y electrónica en el derecho colombiano de
acuerdo con la Ley 527 de 1999, y el Decreto 2364 de 2012; y la connotación
que aún comporta la firma manuscrita, incluso, exigida en algunos lugares
como requisito de validez para ciertos contratos estatales, caso perentorio:
Francia, Bélgica y Grecia.
Abstract
