La culpa en la responsabilidad civil contractual en Colombia: ¿tripartición o culpa unitaria?

Resumen
En el presente documento se analiza el elemento culpa en la responsabilidad civil contractual en Colombia, para esto, presenta la dicotomía existente entra la culpa tripartita y la culpa unitaria. Explora los orígenes de la tripartición de la culpa y su incorporación en nuestra normativa, al igual, que indaga sobre su inaplicabilidad en las sentencias judiciales ; para esto, se expone cómo llegó a nuestro ordenamiento jurídico una clasificación de las obligaciones, no consagrada en el Código Civil, y, de vital importancia para el estudio de la culpa contractual y la estructuración de la responsabilidad civil, esto es, las obligaciones de medios y de resultados. Este breve escrito se aparta de la posición mayoritaria y aboga por la tripartición de la culpa como un elemento estructural vigente, necesario y útil en el campo de la responsabilidad civil contractual.
This document analyzes the element of fault in contractual civil liability in Colombia, specifically focusing on the dichotomy between tripartite fault and unitary fault. It explores the origins of tripartition of fault and its incorporation into our legal framework, as well as investigates its inapplicability in judicial decisions. To achieve this, it discusses how a classification of obligations, not enshrined in the Civil Code but of vital importance for the study of contractual fault and the structuring of civil liability, came to be part of our legal system. This classification refers to obligations of means and obligations of results. This brief writing departs from the majority position and advocates for tripartition of fault as a valid, necessary, and useful structural element in the field of contractual civil liability.
