A model actancial for the study of constitutional jurisprudence in Colombia: a view from four fundamental rights of the population deprived of liberty

Resumen
La jurisprudencia constitucional en Colombia es principalmente analizada mediante el uso de técnicas de análisis jurisprudenciales tradicionales que se basan en el estudio del precedente judicial para tres fines particulares: la aplicación del derecho en casos concretos, la interpretación de disposiciones legales, y suplir vacíos normativos en ausencia de legislación. De otro lado, es poco común el estudio de la jurisprudencia desde otras técnicas de análisis cualitativo de datos. Es en ese sentido que, los avances de investigación presentados en este artículo intentan mostrar cómo estudiar la jurisprudencia constitucional desde un enfoque semiótico haciendo uso de la herramienta analítica de los modelos actanciales.
Concretamente se busca aplicar el modelo actancial de A.J. Greimas sobre la jurisprudencia constitucional de cuatro derechos fundamentales de la población privada de la libertad en Colombia: derecho a la unidad familiar, a la libertad religiosa y de cultos, a la libertad sexual-visita íntima y derecho al trabajo penitenciario. Para finalmente obtener una estructura actancial que dé cuenta de los elementos narratológicos presentes en las sentencias judiciales cuando estas son estudiadas desde la semiótica como un relato narrativo.
Constitutional jurisprudence in Colombia is analyzed using techniques traditional of jurisprudential analysis which are based on the study of judicial precedent for three purposes in particular: the application of the law in specific cases, the interpretation of the law, and to fill normative gaps. On the other side, is uncommon the study of jurisprudence from other qualitative data analysis techniques. It is in this sense that the research advances presented in this paper try to show how to study constitutional jurisprudence from a semiotic approach using the analytical tool of actantial models. Specifically, it seeks to apply the actantial model of A.J. Greimas on constitutional jurisprudence of four fundamental rights of people deprived of their liberty in Colombia: right to family unity, religious freedom, sexual freedom-intimate visit, and right to prison work. To finally obtain an actantial structure that accounts for the narratological elements present in the judicial rulings when they are studied from semiotics as a narrative story.
