El presente trabajo de investigación parte de una breve identificación del inicio de la historia constitucional mexicana, así como del análisis de las leyes supremas vigentes durante los siglos XIX y XX respecto del sistema de recepción del derecho internacional y de la jerarquía de los tratados internacionales dentro del orden jurídico. Posteriormente, se analiza el desarrollo jurisprudencial sobre la vigencia del bloque de constitucionalidad, llevándonos a realizar una fuerte crítica respecto de las implicaciones que conlleva su restricción dentro de un contexto que indiscutiblemente demanda hoy más que nunca, el respeto y la garantía de los derechos humanos.
This research starts from a brief identification of the beginning of Mexico’s constitutional history, as well as the analysis of the supreme laws during the XIX and XX centuries with respect to the receiving system of international law and the hierarchy of international treaties within the legal order. Subsequently, analyzes the jurisprudential development about the validity of the constitutional block, leading to make a hard criticism regarding the implications of its restriction within a context that undoubtedly demands more than ever, respect and guarantee for human rights.
