Limitaciones burocráticas en infraestructura pasiva de telecomunicaciones en Lima Metropolitana (2021–2024)

dc.descriptionIn the Peruvian context, telecommunications are a key component for social and economic progress. Despite this, in Metropolitan Lima, local regulations and administrative procedures have hindered the expansion of this infrastructure by imposing additional conditions stipulated in Law 29022. In this sense, the aim is to identify and analyze the main bureaucratic barriers affecting the sector in San Borja, Ancón, Lince, Jesús María, and Metropolitan Lima. To achieve this, a qualitative approach was used, and the documentary analysis technique was applied to the resolutions issued by the Specialized Chamber on Bureaucratic Barriers during the period 2021-2024. The results highlight, on the one hand, that the identified bureaucratic barriers contravene the national legal framework, specifically Law No. 29022, by imposing additional requirements that disregard the automatic approval regime and administrative simplification; on the other hand, local governments exceed the competences assigned by law and intervene in areas reserved for other institutions. In conclusion, it can be stated that the bureaucratic barriers established by municipal authorities in Metropolitan Lima between 2021 and 2024 have hindered the implementation of passive telecommunications infrastructure. Therefore, it is recommended that local governments eliminate any additional administrative requirements beyond those established in Law No. 29022 and restrict their actions to avoid exceeding their competences in contradiction to the national legal framework.en-US
dc.descriptionEn el contexto peruano, las telecomunicaciones son un componente clave para el progreso social y económico. A pesar de ello, en Lima Metropolitana, las regulaciones y procedimientos administrativos locales han dificultado la expansión de esta infraestructura al imponer condiciones adicionales estipuladas en la Ley 29022. En este sentido, se pretende identificar y analizar las principales barreras burocráticas que afectan el sector en San Borja, Ancón, Lince, Jesús María y Lima Metropolitana. Para ello, se utilizó un enfoque cualitativo y se aplicó la técnica de análisis documental a las resoluciones emitidas por la Sala Especializada en Barreras Burocráticas en el período 2021-2024. Los resultados destacan, por un lado, que las barreras burocráticas identificadas contravienen el marco legal nacional, específicamente la Ley 29022, al imponer requisitos adicionales que ignoran el régimen de aprobación automática y simplificación administrativa; por otro lado, los gobiernos locales exceden las competencias asignadas por ley e intervienen en áreas reservadas a otras instituciones. En conclusión, se puede afirmar que las barreras burocráticas establecidas por las autoridades municipales en Lima Metropolitana entre 2021 y 2024 han obstaculizado la implementación de infraestructura pasiva de telecomunicaciones. Por ello, se recomienda a los gobiernos locales eliminar cualquier requisito administrativo adicional a los establecidos en la Ley 29022, y restringir que excedan sus competencias al contradecir el marco legal nacional.es-ES
