That is why, from the legal, doctrinal and jurisprudential point of view, a documentary, monographic study called Analyzing the legal elements in the light of the partition in life is sought. The purpose of this study is to establish what is the current situation of Colombian inheritance law allowing to determine the basic concepts of succession law, as well as the process of transformation, and that, despite the dilemmas surrounding the application of said article, it is necessary that Colombia, offer an updated inheritance right, according to the realities and requirements of today's society, the analysis of the law compared in countries such as Spain, Switzerland, United States, Costa Rica, allowed to establish how they have adjusted the succession law Applying the Succession among the living, managed to adapt its laws in favor of new social changes, as well as greater protection of testamentary freedom.
