TEST DE PONDERACIÓN ENTRE LA PROTECCIÓN DE LOS ARRECIFES CORALINOS Y EL TRABAJO PESQUERO

Este artículo de investigación desarrolla el tema de la ponderación entre el derecho a un ambiente sano, específicamente frente a la protección de los arrecifes coralinos y, por otro lado, el derecho al trabajo de las personas que ejercen la actividad pesquera. Se aborda este tema teniendo en cuenta que, una de las principales problemáticas en los arrecifes de coral es la sobrepesca, si bien en un tiempo esta actividad era ilimitada, con los años debió regularse considerando que los recursos naturales no eran renovables, y se estaba generando la perdida de estos corales que son base para que existan los animales marinos.
A través de la ponderación de Robert Alexy, se buscó llegar a la conclusión sobre qué derecho puede prevalecer más, si la protección de los arrecifes de coral o el derecho al trabajo.
Una vez realizada la ponderación de Robert Alexy, se pudo determinar que, el derecho al medio ambiente sano prevalece sobre el derecho al trabajo, lo anterior, atendiendo a que el primero no se puede recuperar frente al segundo, que si bien las personas dependen de la actividad pesquera pueden buscar alternativas de trabajo para poder subsistir con el fin de tener un mínimo vital idóneo para su estilo de vida, situación que no sucede frente a los arrecifes de coral.
Abstract
This research article develops the issue of weighing the right to a healthy environment, specifically in relation to the protection of coral reefs and, on the other hand, the right to work of the people who carry out fishing activities. This issue is approached taking into account that one of the main problems in coral reefs is overfishing, although at one time this activity was unlimited, over the years it had to be regulated considering that natural resources were not renewable, and it was generating the loss of these corals that are the basis for the existence of marine animals.
Through Robert Alexy's weighting, the conclusion was sought as to which right could prevail more, the protection of coral reefs or the right to work.
Once the weighting of Robert Alexy was carried out, it was determined that the right to a healthy environment prevails over the right to work, considering that the former cannot be recovered from the latter, that although people depend on fishing activities, they can look for work alternatives to be able to subsist in order to have an adequate vital minimum for their lifestyle, a situation that does not occur with respect to coral reefs.
