Abstract

The traditional analysis of human rights is subsumed in a series of assumptions from which is assumed that the guarantee of this rights is supported by the constructs that make up the legal order of modern nations, a situation that ignores the existing gap between the obligations that fall on the public administration (in human rights issues) and the material possibilities of the State to have the resources, instruments and procedures that are required so that in reality the obligations on which the guarantee of rights refer to materialize, taking as analysis variables the multidimensionality and simultaneity that the exercise of the public function supposes with regard to fundamental rights, from the perspective of the best interests of the minor in the analysis of the right to education for Venezuelan migrant children and adolescents In Colombia.
