Resumen

El presente artículo analiza la procedencia excepcional de la acción de tutela como mecanismo constitucional de defensa judicial contra las providencias que se dicten al interior del recurso de habeas corpus, como instrumento para garantizar el derecho fundamental al debido proceso en el marco de la actuación judicial que defina la solicitud de libertad. En ese orden, se propone realizar un contraste jurisprudencial de posiciones entre la Corte Constitucional y la Corte Suprema de Justicia desde los pronunciamientos más recientes de cada Corporación, por lo tanto, el estudio de fondo que se convoca en esta oportunidad se realizara definiendo en principio, los aspectos jurídicos generales de la acción de tutela, abordando los requisitos de procedencia del recurso de amparo para cuestionar decisiones judiciales, y así descender con especial interés, en los criterios de procedencia que han fijado las altas Cortes, para habilitar el amparo constitucional por la excepcional senda de la acción de tutela en los trámites de habeas corpus.

Abstract

This article analyzes the exceptional origin of the tutela action as a constitutional mechanism of judicial defense against the orders issued within the habeas corpus appeal, as an instrument to guarantee the fundamental right to due process within the framework of judicial action, which defines the request for freedom. In that order, it is proposed to make a jurisprudential contrast of positions between the Constitutional Court and the Supreme Court of Justice from the most recent pronouncements of each Corporation, therefore, the background study that is called for on this occasion will be carried out by defining in principle, the general legal aspects of the tutela action, addressing the requirements of the origin of the amparo appeal to question judicial decisions, and thus descend with special interest, in the criteria of origin that have been established by the high Courts, to enable constitutional protection through the exceptional path of the tutela action in the habeas corpus proceedings.
