El proyecto de Paz, justicia y legitimidad como paradojas e indeterminación, tiene por objeto dentro del momento del posacuerdo o posconflicto que vive Colombia, abordar las paradojas y la indeterminación que conllevan estas tres categorías de análisis o tres formas de comprender los procesos históricos, sociales y culturales que se advienen en una nación que se debe construir o
reconstruir sin conflicto armado interno. Así que la tarea desde el orden jurídico, desde la filosofía crítica del derecho es avanzar en los retos de repensar la paz, la justicia y la legitimidad. Una de las 2 primeras consideraciones es que la violencia es correlato de la paz, así que es necesario asumir la realidad de violencia que está asida a la vida individual y colectiva de los hombres. De ahí que desde este reconocimiento la justicia ha de dimensionarse como crítica, en donde los jueces recobren el quehacer ético, solidario e inclusivo que les corresponde, y en donde el papel de la mujer en la adjudicación es definitivo, por la perspectiva de género que sin duda facilita cimentar una legitimidad política que redimensione los auténticos fines del Estado social de Derecho; que implican revigorizar la solidaridad y el respeto por la intimidad ver vi gracia en los registros callejeros y en la donación de órganos como expresión de una paz y justicia social, que edifican la legitimidad política.
Abstract
The project of Peace, justice and legitimacy as paradoxes and indetermination, has as its object within the moment of the post-agreement or post-conflict that Colombia is experiencing, to address the paradoxes and the indeterminacy that these three categories of analysis or three ways of understanding the historical, social processes entail and cultural that come in a nation that must be built or rebuilt without internal armed conflict. So the task from the legal order, from the critical philosophy of law is to advance the challenges of rethinking peace, justice and legitimacy. One of the first 2 considerations is that violence is correlated with peace, so it is necessary to assume the reality of violence that is attached to the individual and collective life of men. Hence, from this recognition, justice has to be dimensioned as critical, where the judges recover the ethical, solidary and inclusive work that corresponds to them, and where the role of women in the adjudication is final, due to the gender perspective that it certainly facilitates cementing a political legitimacy that resizes the true ends of the social rule of law; which imply reinvigorating solidarity and respect for privacy, seeing grace in street records and in the donation of organs as an expression of peace and social justice, which build political legitimacy.
