¿El principio de sostenibilidad fiscal es un limitante o un acelerador para el cumplimiento de los fallos judiciales?

Abstract

This article aims to analyze the scope of the application of the principle of fiscal sustainability included in the Constitution, within the judicial decisions issued by the High Courts in the Colombian Social State of Law. Consequently, the text develops within a qualitative research, in which the importance of the principle of fiscal sustainability with the rights of the social conglomerate differs from the perspective of an affectation to which they may be forced the decisions issued in the jurisdiction. The text also developed allows to study the regulatory aspects that regulate the principle of sustainability, and likewise, covers jurisprudential pronouncements and doctrine on the subject, through which aspects that highlight the consequences imposed by the principle identified mention in judicial decisions; and also the presence of positive aspects that promote the protection of state resources.
