Resumen
La República de la unión de Myanmar ha sido un Estado con un largo y complejo proceso histórico, el cual se ha presentado como constante la violencia en contra de la comunidad Rohingya por motivos culturales y religiosos. Esta violencia se ha incrementado especialmente en las últimas décadas, ocasionando desplazamientos de tal comunidad al territorio de Bangladesh, en donde los Rohingya se han ubicado en campos de refugiados donde es necesaria la ayuda humanitaria para poder sobrevivir. Por tal razón la Fiscalía de la Corte Penal Internacional ha decidido solicitar apertura de investigación por la comisión de presuntos crímenes de lesa humanidad en Myanmar. Sin embargo, la Corte se encuentra con una compleja situación y es que el Estado de Myanmar no ha ratificado el Estatuto de Roma, por tanto, la CPI no tiene competencia para adelantar dicha investigación. En el siguiente podcast abordaremos a grandes rasgos el contexto histórico de este conflicto, así como los factores más importantes que la CPI ha desarrollado y la investigación adelantada por la misma para dar apertura a una investigación en un territorio sobre el cual no tendría competencia.
Abstract
The Republic of the Union of Myanmar has been a State with a long and complex historical process, which has been presented as constant violence against the Rohingya community for cultural and religious reasons. This violence has increased especially in recent decades, causing displacement of such a community to the territory of Bangladesh, where the Rohingya have been located in refugee camps where humanitarian aid is necessary to survive. For this reason, the Office of the Prosecutor of the International Criminal Court has decided to request an investigation into the commission of alleged crimes against humanity in Myanmar. However, the Court finds itself in a complex situation and that is that the State of Myanmar has not ratified the Rome Statute, therefore, the ICC does not have the competence to carry out this investigation. In the following podcast we will broadly address the historical context of this conflict, as well as the most important factors that the ICC has developed and the investigation carried out by it to open an investigation in a territory over which it would have no jurisdiction.
