Responsabilidad del estado por la expedición de la ley de víctimas y restitución de tierras: segundos ocupantes

Abstract

The present article aims to conduct a study of State responsibility for the implementation of the Law of Victims and Land Restitution in the case of the second occupants. Within this context, it will be analyzed the State's responsibility for the act or omission of the Lawgiver, taking into account the history of violence, dispossession and forced abandonment of land that preceded the enactment of Law 1448 of 2011, in order to determine whether any liability attributable to the State for the problems that have arisen with the implementation of this law, especially in the case of so-called " seconds occupiers " in the process of land restitution.
