El Estado colombiano se ha convertido en el primer destino de la población venezolana a la hora de buscar refugio y oportunidades, siendo el primer referente por su cercanía y facilidad de ingreso, y servir como puente para trasladarse a otro destinos como Ecuador y Perú; teniendo como medida fronteriza alrededor de 2.219 kilómetros de extensión y contar con siete pasos fronterizos, hace que los venezolanos se desplacen junto a sus familias, dejando de lado el país que los vio nacer, obligados a huir de su arraigo en busca de mejores oportunidades y sobre todo encontrar en otros destinos garantías a los derechos humanos, educación para sus hijos, mejores sistemas de atención en salud, alimentación y el punto más importante un trabajo digno; en lo que respecta a este último punto es de mencionar que un alto porcentaje de personas son tituladas en alguna profesión pero que sus diplomas no son suficientes para un gobierno que los ha condenado al abandono; de igual forma el punto más álgido de la crisis en el vecino país radica en la hiperinflación y devaluación del Bolívar (moneda oficial de Venezuela)
En Colombia con gran dificultad los migrantes del país hermano pueden acceder a lo necesario para su supervivencia y con este último, surge la facilidad de emplearse de manera informal, ya que no es secreto que para el comerciante nacional es mejor contratar un extranjero “ilegal” que en vista de la necesidad que tiene por conseguir sustento para su familia aceptan condiciones laborales poco garantes, en las cuales se someten a largas jornadas laborales a bajo costo, sin el pago de las prestaciones sociales y mucho menos sin la afiliación al régimen de seguridad social.
Por lo anterior, se hace necesario indagar como se está garantizando tanto jurídica como socialmente el derecho al trabajo, delimitando esta investigación en la capital del departamento del Meta, en una población determinada como lo son los migrantes venezolanos.
Abstract
The Colombian state has become the first destination of the Venezuelan population when seeking refuge and opportunities, being the first reference for its proximity and ease of entry, and serving as a bridge to move to other destinations such as Ecuador and Peru; having as a border measure around 2,219 kilometers in length and having seven border crossings, makes Venezuelans move with their families, leaving aside the country where they were born, forced to flee from their roots in search of better opportunities and Above all, find in other destinations guarantees of human rights, education for their children, better health care systems, food and, most importantly, decent work; With regard to this last point, it is worth mentioning that a high percentage of people have degrees in some profession but that their diplomas are not enough for a government that has condemned them to abandonment, just as the highest point of the crisis in the neighboring country lies in the hyperinflation and devaluation of the Bolívar (official currency of Venezuela); But what does Colombia offer our Venezuelan brothers?
In Colombia, with great difficulty, migrants from the sister country can access what is necessary for their survival and with the latter, the ease of being employed informally arises, since it is no secret that it is better for the national merchant to hire an "illegal" foreigner. that in view of the need they have to provide for their family, they accept poor working conditions, in which they submit to long working hours at low cost, without paying social benefits and much less without affiliation to the security regime Social.
Due to the above, it is necessary to investigate how the right to work is being guaranteed both legally and socially, delimiting this investigation in the capital of the department of Meta, to Venezuelan migrants, what is the reality in the face of the protections professed by the national government to the world.
