Resumen
El aumento de la participación de adolescentes en actividades delictivas, representa uno de los presupuestos para la implementación del Sistema de Responsabilidad Penal para Adolescentes (SRPA), el cual tiene un enfoque diferenciado en tanto busca proteger y reducir los delitos cometidos por adolescentes entre los 14 a 18 años de edad, pero la situación actual, es crítica, en el entendido que no solo hay un aumento en los delitos cometidos por esta población, sino un escenario emergente conocido como reincidencia, que consiste en que adolescentes que han incurrido en delitos y han sido objeto de medidas de protección en un mismo año registran más de un hecho delictivo. Frente a las deficiencias que presenta el panorama jurídico penal, resulta plausible ver que en Europa, la noción de la acción jurídico penal, no es una garantía para recudir la manifestación de criminalidad provocada por adolescentes, por ello han acudido a reorientar la intervención o acción del Estado bajo la relación de inclusión y exclusión social que permita asociar riesgos y amenazas en reducir las posibilidad de ocurrencia de delitos de manera reiterativa.
Abstract
The increase in the participation of adolescents in criminal activities represents one of the prerequisites for the implementation of the System of Criminal Responsibility for Adolescents (SRPA), which has a differentiated approach in that it seeks to protect and reduce crimes committed by adolescents between 14 and 18 years of age, However, the current situation is critical, in the understanding that there is not only an increase in crimes committed by this population, but also an emerging scenario known as recidivism, which consists of adolescents who have committed crimes and have been subject to protection measures in the same year registering more than one criminal act. In view of the shortcomings of the criminal legal panorama, it is plausible to see that in Europe, the notion of criminal legal action is not a guarantee to recudiate the manifestation of criminality caused by adolescents, and for this reason they have resorted to reorienting the intervention or action of the State under the relationship of social inclusion and exclusion that allows the association of risks and threats to reduce the possibility of crimes occurring repeatedly.
