Resumen
Con este trabajo quise determinar la validez que se le otorga al documento electrónico como medio de prueba dentro del proceso judicial a través del impacto que han tenido las nuevas tecnologías de la información y las comunicaciones en el campo del derecho, la metodología implementada es de tipo descriptivo, método sistemático, con el uso de fuentes primarias y secundarias, dentro del análisis de resultados se pudo concluir que nuestro sistema jurídico admite la libertad de la prueba que pueden ser llevadas al proceso siempre y cuando estas sean útiles, conducentes y pertinentes, y por supuesto sean oponibles y refutadas por las partes, así mismo, permiten ser valoradas bajo el criterio de la sana critica, buscando como fin dar convencimiento sobre un hecho en un litigio. En la legislación el documento electrónico y los demás tipos de pruebas digitales están investidos de validez sin desconocer que si bien es cierto se le da la participación de estos en todos los campos del derecho a plena libertad.
Abstract
With this work I wanted to determine the validity that is granted to the electronic document as a means of proof within the judicial process through the impact that new information and communication technologies have had in the field of law, the methodology implemented is of type descriptive, systematic method, with the use of primary and secondary sources, within the analysis of results it was possible to conclude that our legal system admits the freedom of the test that can be taken to the process as long as these are useful, conducive and pertinent, and of course they are opposable and refuted by the parties, likewise, they allow to be valued under the criterion of sound criticism, seeking as an end to give conviction about a fact in a litigation. In the legislation the electronic document and the other types of digital evidence are invested with validity without ignoring that although it is true, they are given the participation of these in all fields of the right to full freedom.
