Mediation as an alternative solution in the posconflict in Colombia

El presente artículo pretende hacer una breve relación historiográfica de la violencia en Colombia, desde la perspectiva de la adaptación conceptual del conflicto como antecedente mediato para la promulgación de normas de justicia transicional. Desde allí se concibe el análisis de los postulados del marco legal para la superación del conflicto y los mecanismos dispuestos para el restablecimiento del orden público y el bienestar de la población. En este sentido, es de vital importancia analizar los factores dispuestos que propenden por facilitar la transición del conflicto armado, especialmente desde el enfoque de la reconciliación y reconstrucción del tejido social; teniendo esto en cuenta, y haciendo un estudio de los mecanismos judiciales y extrajudiciales dispuestos para solucionar conflictos. Proponemos un análisis constructivo para implementar herramientas alternativas que permitan minimizar los impactos del posconflicto y sirvan en la aplicación de la justicia y la incidencia que la misma tiene en la superación de conflictos.
This article is trying to make a brief historiographical relationship of violence in Colombia from the perspective of the conceptual adaptation of conflict mediation as background for the promulgation of rules of transitional justice. From this point of view, we are going to analyze the principles of the legal framework for overcoming the conflict and the mechanisms provided for the restoration of public order and welfare of the population. In this sense, is important to analyze the factors that tend to facilitate the transition from armed conflict, especially from the perspective of reconciliation and reconstruction of the social structure; With this in mind, and making a study of the ways to resolve conflicts through judicial and extra-judicial mechanisms, we propose a constructive analysis to implement alternative tools to minimize the impacts of post-conflict recovery and the impact of the armed conflict.
