Esta investigación tiene como finalidad analizar la problemática de la explotación infantil, ya que ha incrementado considerablemente, convirtiéndose así en un problema social en nuestro país. Evidenciaremos como el Estado no se ocupa de este vacío normativo y no es garantista, ya que no toma las medidas pertinentes y necesarias para la prevención o mitigación del fenómeno, tampoco protege los derechos fundamentales de los menores de edad. Este trabajo de investigación tiene un enfoque social y jurídico. Se evidencia que la sociedad y el Estado no se interesan por buscar una pronta solución respecto de dicha realidad, ya que la normatividad en muchos casos es invisible e ineficiente. Por esta razón actualmente se identifica que los menores de edad son instrumentos de explotación en las calles de nuestro país con el objetivo de generar una sensación de lastima en los ciudadanos. En primero lugar se revisa históricamente el trabajo infantil a nivel mundial y nacional. Así mismo, se analizan los tratados internacionales que regulan este problema. Se contextualiza antropológica y socialmente el trabajo infantil, y finalmente se observa la normativa y la jurisprudencia que regula la explotación infantil en Colombia.
Abstract
The purpose of this research is to analyze the problem of child exploitation, which has increased considerably, becoming a social problem in our country. We will demonstrate how the State fails to address this regulatory gap and fails to provide guarantees, as it fails to take the pertinent and necessary measures to prevent or mitigate the phenomenon, nor does it protect the fundamental rights of minors. This research has a social and legal focus. It demonstrates that society and the State are uninterested in seeking a prompt solution to this situation, as regulations are often invisible and inefficient. For this reason, minors are currently identified as instruments of exploitation on the streets of our country, with the aim of generating a sense of pity in citizens. First, we review the history of child labor at the global and national levels. Likewise, we analyze the international treaties that regulate this problem. We contextualize child labor anthropologically and socially, and finally, we examine the regulations and jurisprudence that govern child exploitation in Colombia.
