El acceso justo y oportuno a los servicios de salud en Colombia constituye un tema de alta relevancia social y jurídica, que exige análisis profundo y propuestas concretas de mejora. Este proyecto de investigación surge ante la persistencia de brechas en la garantía efectiva del derecho fundamental a la salud, directamente relacionado con el bienestar y el desarrollo integral de la población.
El derecho a la salud, pilar de la dignidad humana, debe garantizarse de manera equitativa y oportuna para todos los ciudadanos, sin discriminación. Este principio está respaldado por la Constitución Política de Colombia y la Ley Estatutaria de Salud (Ley 1751 de 2015), que reconocen la salud como un derecho fundamental autónomo. No obstante, la realidad evidencia deficiencias significativas en el acceso, calidad y oportunidad de los servicios, lo que hace indispensable la búsqueda de soluciones innovadoras.
La investigación se alinea con el Plan Nacional de Desarrollo 2022-2026, orientado a fortalecer el sistema de salud y reducir desigualdades, especialmente en poblaciones vulnerables y regiones históricamente desatendidas. Asimismo, contribuye al cumplimiento de los Objetivos de Desarrollo Sostenible, en particular el ODS 3 (Salud y Bienestar) y el ODS 10 (Reducción de las Desigualdades).
El estudio abordará el acceso a la salud como un desafío multidimensional, analizando factores como infraestructura, talento humano, accesibilidad geográfica y económica, calidad del servicio y aceptabilidad cultural, así como determinantes sociales de la salud. Además, propondrá soluciones basadas en avances como la telemedicina, la atención primaria y la promoción de la salud, con el fin de fortalecer un sistema sanitario más equitativo, eficiente y resiliente, capaz de responder tanto a contextos normales como a situaciones de emergencia.
Abstract
Fair and timely access to health services in Colombia is a highly relevant social and legal issue that demands in-depth analysis and concrete proposals for improvement. This research project arises from the persistent gaps in the effective guarantee of the fundamental right to health, which is directly related to the well-being and comprehensive development of the population.
The right to health, a pillar of human dignity, must be guaranteed equitably and promptly for all citizens, without discrimination. This principle is supported by the Political Constitution of Colombia and the Statutory Health Law (Law 1751 of 2015), which recognize health as an autonomous fundamental right. However, reality reveals significant deficiencies in the access, quality, and timeliness of services, making the search for innovative solutions essential.
This research aligns with the 2022-2026 National Development Plan, which aims to strengthen the health system and reduce inequalities, especially among vulnerable populations and historically underserved regions. It also contributes to the achievement of the Sustainable Development Goals, particularly SDG 3 (Good Health and Well-being) and SDG 10 (Reduced Inequalities).
The study will address access to healthcare as a multidimensional challenge, analyzing factors such as infrastructure, human resources, geographic and economic accessibility, service quality and cultural acceptability, as well as the social determinants of health. Furthermore, it will propose solutions based on advancements such as telemedicine, primary care, and health promotion, with the aim of strengthening a more equitable, efficient, and resilient healthcare system, capable of responding to both normal circumstances and emergency situations.
