Al margen de la legislación colombiana, la consolidación de un sistema normativo que efectúe el tratamiento jurisprudencial respecto a la responsabilidad médica estatal en cirugías en las que se dejan de manera involuntaria oblitos quirúrgicos que puedan afectar la estabilidad física, psíquica y emocional del paciente intervenido, puede resultar no ser plenamente satisfactoria, se pretende identificar la falla del servicio y responsabilidad estatal, cuando el sujeto de derecho es intervenido a través de una cirugía.
En este contexto emerge el servicio médico o de salud como un derecho humano, del cual constituye el objeto de análisis a partir de los preceptos de la responsabilidad estatal, la atención y responsabilidad médica y los derechos fundamentales y básicos del paciente.
Abstract
Apart from Colombian legislation, the consolidation of a regulatory system to provide for the case-law treatment of State medical liability in surgeries where surgical and non-surgical materials that may affect physical stability are left unintentionally. The psychological and emotional state of the intervened patient may not be fully satisfactory, it is intended to identify the failure of the service and state responsibility, with the subject of law, is intervened through surgery.
In this context, the medical or health service emerges as a human right, from which it is the object of analysis based on the precepts of State responsibility, medical care and responsibility and the fundamental and basic rights of the patient.
