Resumen

Esta investigación se enfocó en el activismo judicial de la Corte Constitucional, donde la Corte Constitucional ha desarrollado la procedencia de la Acción de Tutela contra providencias judiciales motivo de discordia con los otros máximos tribunales, lo cual ha generado el llamado "Choque de Trenes" que ha tenido como gran trascendencia la vulneración al acceso a la justicia y tutela judicial efectiva. Se podría decir que el activismo judicial es una función que desborda el ámbito judicial y se integra en el ámbito legislativo, esto es, llenando vacíos legales a través de pronunciamientos judiciales. Un antecedente importante fue la sentencia C 543 de 1992 la cual se enmarca en una decisión propia del activismo judicial, el cual ha tenido un papel protagónico en las decisiones de los magistrados que conforman las Altas Corte en Colombia.

Abstract

This investigation focused on the judicial activism of the Constitutional Court, where the Constitutional Court has developed the origin of the Tutela Action against judicial decisions, reason for discord with the other highest courts, which has generated the so-called "Train Clash" that the violation of access to justice and effective judicial protection has been of great importance. It could be said that judicial activism is a function that goes beyond the judicial scope and is integrated into the legislative sphere, that is, filling legal gaps through judicial pronouncements. An important precedent was the C 543 of 1992 which is framed in a decision of judicial activism, which has had a leading role in the decisions of the judges that make up the High Court in Colombia.
