La jurisdicción agraria puede considerarse un órgano esencial y clave en la materialización de la reforma agraria para conseguir resultados sólidos y permanentes que contribuyan a la paz y desarrollo del Estado colombiano a través de la resolución de los conflictos relacionados con la distribución poco equitativa de la tierra y la ausencia de políticas integrales enfocadas en el fortalecimiento del sector rural colombiano. Empero, aún se visualiza con rasgos inciertos la correcta puesta en marcha de una jurisdicción que cumpla con el fin para el cual fue creada: Administrar justicia en el sector asignado. Por ende, el presente proyecto tiene como ahondar sobre la jurisdicción agraria y las particularidades que debe afrontar para convertirse en un sistema real e idóneo en Colombia.
Teniendo en cuenta que se trata de un estudio cualitativo, que no admite la aplicación de una metodología “ensayo-error”, se optó por indagar las respecto de las posturas de juristas y en material informativo de carácter gubernamental, a fin de entender un poco sobre la trayectoria de la reforma agraria desde sus inicios hasta nuestros días, la repercusión del acuerdo de paz en este proceso, y como a través de la reforma agraria y en consecuencia, la implementación de la jurisdicción agraria, se le apuesta a la paz en Colombia.
Abstract
The agrarian jurisdiction can be considered an essential and key body in the implementation of agrarian reform, aiming to achieve solid and lasting results that contribute to peace and development in the Colombian state by resolving conflicts related to the unequal distribution of land and the lack of comprehensive policies focused on strengthening the rural sector in Colombia. However, the proper implementation of a jurisdiction that fulfills the purpose for which it was created—administering justice in the assigned sector—still appears uncertain. Therefore, this project aims to delve into the agrarian jurisdiction and the particular challenges it must face in order to become a real and suitable system in Colombia.
Given that this is a qualitative study, which does not allow for a “trial-and-error” methodology, the approach chosen was to investigate the positions of legal scholars and government informational materials in order to understand the trajectory of agrarian reform from its beginnings to the present day, the impact of the peace agreement on this process, and how agrarian reform—and consequently, the implementation of agrarian jurisdiction—is a key part of the effort to achieve peace in Colombia.
