El fenómeno migratorio ha llevado a diferentes países a formular políticas para enfrentar esta crisis migratoria. Dentro de la literatura académica, la comparación entre el Estatuto Temporal de Protección para Migrantes Venezolanos de Colombia y el Estatuto de Protección Temporal de Estados Unidos no ha sido desarrollada suficientemente, por lo tanto, esta investigación aborda estos estatutos enfocándose en las diferencias y similitudes que estos tienen al momento de sobrellevar el fenómeno migratorio en ambos países. Utilizando la técnica de análisis documental de estos dos estatutos para crear una matriz de análisis que incluye 6 categorías (antecedentes, principios, derechos, solicitud, permanencia y periodo de registro). A manera de conclusión, ambos estatutos cuentan con diferentes lineamientos, así mismo coinciden en su propósito, el cual está enfocado en poder manejar la crisis migratoria, poder salvaguardar los derechos de los migrantes y poderles ofrecer mejores oportunidades en comparación con su propio país, y así generar nuevo conocimiento en el tema migratorio.
Abstract
The migratory phenomenon has led different countries to formulate policies to face this migratory crisis. Within the academic literature, the comparison between the Temporary Protection Statute for Venezuelan Migrants of Colombia and the Temporary Protection Statute of the United States has not been sufficiently developed, therefore, this research addresses these statutes focusing on the differences and similarities that they have at the time of coping with the migratory phenomenon in both countries. Using the technique of documentary analysis of these two statutes to create an analysis matrix that includes 6 categories (background, principles, rights, application, permanence, and registration period). In conclusion, both statutes have different guidelines, but they also coincide in their purpose, which is focused on managing the migratory crisis, safeguarding the rights of migrants, and offering them better opportunities compared to their own country, thus generating new knowledge on migration issues.
