Este trabajo analiza cómo se organiza y sistematiza el derecho en Australia. Explica el origen del sistema jurídico australiano en el common law inglés, su estructura federal y las principales fuentes del derecho, como la legislación y la jurisprudencia. También describe instituciones importantes como la High Court of Australia, la Australian Law Reform Commission y el Federal Register of Legislation, que ayudan a mantener el orden y la coherencia del sistema legal. Finalmente, se reflexiona sobre cómo algunos elementos del modelo australiano podrían servir como referencia para mejorar la organización del derecho en países latinoamericanos como Colombia.
Abstract
This paper analyzes the systematization of the Australian legal system. It explains the historical origin of Australian law in the English common law tradition, as well as the federal structure that shapes its legal organization. The study also examines the main sources of law, including legislation and judicial decisions, and highlights the role of key institutions such as the High Court of Australia and the Australian Law Reform Commission. Finally, the paper reflects on how the Australian experience can provide useful insights for improving legal organization in Latin American countries, particularly Colombia.
