Paradójicamente entendiendo que el trabajo sexual es un fenómeno social derivado de factores específicos, que además es uno de los negocios más lucrativos a nivel mundial, y que se desarrolla dentro de un Estado Constitucional, se tiene que hay un déficit normativo teniendo en cuenta los derechos laborales de esta población, quedando desprotegidas y discriminadas no sólo por ellas mismas sino por la sociedad y el gobierno al que pertenecen. Por lo anterior se encuentra la necesidad de emprender correcciones que amparen sus derechos mediante acciones afirmativas y no a través de mecanismos con garantía individual.
Abstract
Paradoxically understanding that the sexual work is a social phenomenon derived from specific factors, which in addition is one of the most lucrative business worldwide, and that it develops inside a Constitutional State, there is had that there is a normative deficit bearing in mind the labor laws of this population, staying unprotected and discriminated not only for them themselves but for the company and the government to which they belong. For the previous thing one finds the need to undertake corrections that protect his rights by means of affirmative actions and not across mechanisms with individual guarantee.
