El enriquecimiento sin justa causa como fuente de obligaciones en el área del
derecho público ha sido tratado de manera escasa en nuestro ordenamiento jurídico
positivo. En efecto, el tema se desarrolló en Colombia mediante fuentes netamente
jurisprudenciales, sin que exista actualmente una acción o medio de control específico
para ventilar los litigios entre la Administración y los particulares con motivo de la
ocurrencia de este fenómeno jurídico.
Mediante este trabajo de investigación, orientado según el método inductivo, se
pretende analizar la figura jurídica de enriquecimiento sin justa causa o actio in rem verso
en Colombia, analizando su desarrollo jurisprudencial, su evolución histórica y la
existencia de esta figura en el derecho comparado.
