Este artículo científico, tiene como finalidad el estudio, desde el punto de vista legal y jurisprudencial; si esta herramienta “facultad discrecional”, ha permitido mejorar el servicio Policial o por el contrario ha permitido con su aplicación el abuso del derecho, desde una interpretación equivoca al momento de aplicarla a sus subalternos, configurándose un abuso del poder de quien la ostenta y de esta manera justificar su aplicación, trayendo con ello una violación sistemática de derechos fundamentales dentro de un Estado Social de Derecho.
Abstract
Discretion is a legal tool that was instituted to strengthen the improvement of the police service; but his misinterpretation through its application in time, has exceeded its power by bringing a systematic violation of basic rights and diversion of power in a social state of law, therefore the maximum of the constitutional court has ruled the respect putting limits that right in its arbitrariness reason to apply when making this so that the rights of persons to whom it is applied is respected.
Similarly the maximum court has cast a jurisprudential development of this power, and in most of cases the state is avocado by multiple demands, which ends up sentenced to bringing its misinterpretation and abuse of power, compensation affected.
