La doctrina dominante (alemana) considera que el injusto imprudente se encuentra constituido por la infracción del deber objetivo de cuidado (tipo objetivo) y, por otra parte, la posibilidad de cumplir con ese deber, el cual hace parte del juicio de culpabilidad, determinando que el primer requisito hace parte del injusto y el segundo a la culpabilidad. Así las cosas, en la categoría de la culpabilidad se verificará el poder subjetivo del autor de cumplir con la norma objetiva (deber objetivo de cuidado) exigible en el caso concreto. Por tanto, si el poder individual del autor es inferior a la del hombre medio la culpabilidad del autor disminuye o se extingue. Considero adecuada la formulación de un tipo objetivo y subjetivo de tipo imprudente, en el que se exija ya la verificación del poder individual -superior o inferior- en la determinación del cumplimiento del deber objetivo de cuidado, el cual exige la verificación objetiva y subjetiva de la conducta adecuada.
Abstract
The dominant (German) doctrine considers that the unjust reckless is constituted by the violation of the objective duty of care (objective type) and, on the other hand, the possibility of fulfilling that duty, which is part of the guilty trial, determining that the first requirement is part of the unfair and the second to guilt. Thus, in the category of guilt will be verified the subjective power of the author to comply with the objective rule (objective duty of care) required in the specific case. Therefore, if the author's individual power is inferior to that of the average man, the author's guilt diminishes or dies out. I consider the formulation of an objective and subjective type of reckless type adequate, in which the verification of individual power - higher or lower - is already required in determining the fulfillment of the objective duty of care, which requires the objective and subjective verification of proper behavior
