Abstract

Corruption is one of the obstacles that countries face for good economic and social development, which affects society since the budget for the provision of basic services such as health, education, housing, etc .; making it impossible to improve the quality of life of citizens endangering people's lives and on the other hand there is abuse of power and obtaining benefits. It is evident that the regulatory factors against corruption in Colombia and in many countries such as Brazil present legal and regulatory weaknesses, where the functions of the penalty have been ineffective in putting an end to this phenomenon. In that sense, a normative implementation of the Colombian penal code must be made so that both the sanction and the control of corruption in the public administration really have efficiency and there is no affectation to a fundamental right such as health, as it has been It has been implementing the criminal policy of some neighboring countries
