    In matters of criminalization of conduct or the application of the procedural regime in the face of different crimes, the weighing takes an important role from the point of view of all the rights that a prisoner has at stake, on several occasions the court has indicated that it must be given criteria of reasonableness and proportionality, such a circumstance cannot become a way of undermining the guarantees of the accused, making, for example, the situation of the offender more burdensome, or preventing the offender from fully exercising his rights.

    This article will address the definition of congruence from a perspective normative starting with the inter-American spectrum of protection of human rights for later include the Political Constitution of 1991, the norm and jurisprudence, this, in for the sake of knowing the description that the different sources have provided about it. Once the descriptive component has been covered, the variations that have been presented over the years in the jurisprudential pronouncements which will allow elucidate the reason for the current jurisprudential position regarding consistency. Finally, we will address the guarantees of the rights that assist the processed and its affectation due to the lack of consistency within the course of the criminal process.
