Resumen
En las últimas décadas se han presentado grandes Olas migratorias de ciudadanos colombianos hacia otros países y viceversa, los cuales buscan mejores oportunidades laborales para mejorar la calidad de vida, esta situación ha generado que los distintos países receptores de estos migrantes contemplen la opción de crear convenios en materia de seguridad social en pensiones, con el fin de poder garantizar algún ingreso económico o grado de protección a estas personas ante ciertas contingencias que se puedan presentar en sus labores cotidianas en medio de este fenómeno de globalización social.
La presente investigación pretende identificar las garantías y la forma como se protegen los derechos pensionales de los Colombianos y extranjeros, describir y analizar los convenios internacionales de seguridad social en pensiones que ha suscrito Colombia, especialmente, el suscrito con el Reino de España, desde el punto de vista operativo, funcional de realidad migratoria y de protección social en los riesgos de invalidez, vejez y muerte; Así mismo, se procura conocer por qué no se contemplan en estos convenios las contingencias derivadas del aseguramiento ante riesgos laborales y salud.
Así pues, se analiza las tendencias de protección social en pensiones de acuerdo con las normas internas de cada Estado suscriptor de convenio. Bajo este análisis se puede conocer el estado actual de la protección social en Colombia en comparación a otras naciones. Esto se efectúa mediante un estudio mixto desde la perspectiva de migrantes colombianos en países suscriptores de los diversos acuerdos, al totalizar, promediar e identificar cuántos colombianos han logrado obtener una prestación pensional en estos convenios. El resultado espera aportar un insumo académico, político y social para evaluar las garantías de los tratados internacionales de protección social suscritos por Colombia y su efectividad.
Abstract
In recent decades in Colombia there have been large waves of immigration from citizens to other countries and vice versa in search of better job opportunities, improve the quality of life; This situation has generated the need for the different receiving countries of these migrants to consider the option of creating social security agreements in pensions, in order to be able to guarantee some economic income or degree of protection to these people against certain contingencies. that can be presented in their daily work, which has generated a social globalization.
The present investigation tries to identify the guarantees and the way in which the pension rights of Colombians and foreigners are protected, describe and analyze the international agreements of social security in pensions that Colombia has signed, especially, the one signed with the Kingdom of Spain, from the operational, functional point of view of migratory reality and social protection in the risks of disability, old age and death; Likewise, it is sought to know why the contingencies derived from insurance against occupational and health risks are not contemplated in these agreements.
It will seek to analyse social protection trends in pensions, in accordance with the internal rules of each State subscribing to the agreement. Under this analysis, the current state of social protection in Colombia can be known in comparison to other states. A mixed study is proposed from the point of view of Colombian migrants in countries that subscribe to the different agreements, totalling, averaging and identifying how many Colombians have managed to obtain a pension benefit on the occasion of these agreements. The expected result will provide an academic, political and social input to evaluate the guarantees of the international Social Protection agreements signed by Colombia and therefore its effectiveness.
