    Mecanismos para la reintegración social humana de NNA en actividades mineras en el municipio de Istmina, Chocó

    This research explores how children and adolescents become involved in miningrelated activities in Istmina, Chocó, by adopting a socio-legal, human-rights lens that treats coordination with the Diocese of San Juan as the central pathway for protection and social reintegration, while keeping the design within the limits of nondirect intervention. To move from normative claims to an ordered empirical basis, three instruments were administered to households, diocesan personnel, and municipal offices, allowing the study to delineate conditions of participation, to examine the requirements for a transition toward non-mining environments, to map actors with decision-making or mediating capacity, and to derive guidelines for institutional articulation. The evidence points to participation clustered in adolescence and organized mainly around panning practices, with consequences that appear in the school trajectory through absences and performance disruptions, while exposure to occupational hazards persists in settings where the use of personal protective equipment is scarcely reported. At the household level, economic constraints and everyday logistical frictions shape educational continuity, whereas municipal structures report gaps that take administrative form through the lack of specific records, protocols, and earmarked budgets, alongside coordination that remains intermittent. Within this configuration, the Diocese stands out through territorial access and channels of trust, even as the absence of written procedures and dedicated resources limits the conversion of pastoral contact into sustained pathways. The study therefore argues that effective coordination depends on technical roundtables, referral and follow-up routes, community-based care spaces, and alignment with public provision so that household income and sustained schooling can function as the conditions through which protection and reintegration become practicable.

    This research analyzes the role of restorative justice as a fundamental axis of the Colombian transitional justice model, particularly in its application within the Special Jurisdiction for Peace (JEP). From a legal, ethical and social perspective, this model does not replace traditional criminal justice; it complements it, since it incorporates truth, reparation and reconciliation as the essential aims of the Social State of Law, and therefore restorative justice as well. There is no doubt that restorative justice constitutes a valid and humane response which enables criminal justice, by placing victims at the centre of the process, to facilitate social reconciliation and the reconstruction of the social fabric, especially when it is an armed conflict. With regard to methodology, this study is grounded in a mixed-methods approach that combines verification and argumentative construction, as well as deduction, induction, and analogical analysis. These methods are applied to the analysis of the constitutional foundations and international treaties underpinning the model, the practices of the JEP, and the tensions between the JEP and retributive justice. The findings suggest that restorative interventions have, to a large extent, honored the victims. Likewise, they have promoted the acknowledgment of responsibility. Public trust in judicial institutions, particularly in the areas of institutional sustainability, public education, and the genuine and effective participation of victims, has recovered significantly. In summary, restorative justice emerges as an ethical, legal, and political imperative for cementing a firm and lasting peace. Specifically, the shift from a punishment-centered ideology toward a culture of encounter and dialogue redefines punishment, transforming it into a setting for reparation and collective learning. Thus, the Colombian experience demonstrates that reconciliation and justice, far from being opposites, constitute inextricably linked paths. Both are vital for restoring human dignity and ensuring the non-repetition of tragic events.

    This research analyzes the violation of human rights of young people who belong to reconstituted families affected by forced displacement in the Los Álamos neighborhood –Arrocero sector, northern area of Quibdó (Chocó). The study addresses forced displacement as a phenomenon linked to armed conflict, structural violence, and land expropriation, with direct consequences on the family nucleus, education, health, safety, and social integration of minors. It is evident that the absence of parental authority, the breakdown of the couple, exposure to community violence, and economic precariousness systematically generate violations of fundamental rights recognized in the Political Constitution of Colombia and in international human rights instruments, such as the International Covenant on Economic, Social and Cultural Rights and the UN Guiding Principles on Internal Displacement. The research highlights the need for legal and social public policies that ensure comprehensive protection of the rights of displaced youth, promote the restitution of their rights, strengthen family cohesion, and guarantee their full development as rights-holding individuals.

    Factores desencadenantes de violación a los derechos humanos en el contexto del desplazamiento forzado en el corregimiento El Medio, Nóvita- Chocó, 2021-2023.

    This study examines the factors contributing to human rights violations in the context of forced displacement in El Medio, Nóvita (Chocó), between 2021 and 2023. Using an interpretative qualitative approach, complemented by descriptive quantitative methods, it aims to document the experiences of Afro-Colombian communities affected by armed conflict, territorial control by illegal groups, and institutional exclusion. Displacement is understood not as a collateral effect of war, but as a deliberate strategy of domination. The methodology includes interviews, focus groups, and structured surveys. The research is grounded in the capabilities approach, restorative justice, and collective rights, proposing a reparation framework that goes beyond material compensation—focusing instead on dignity, memory, and effective participation. The study seeks to fill critical gaps in empirical data and contribute to the development of public policies with an ethnic-territorial focus, particularly for historically marginalized regions such as Colombia’s Pacific coast.

    In a general context, judicial activism could imply an ideological bias or whim, accompanied by arbitrariness and irrationality within the exercise of jurisdiction. Despite this, in Colombia, judicial activism has been implemented favorably as long as it is used to prevent violations of fundamental rights. Therefore, this research aims to provide those interested in the law, and the community at large, with scenarios that facilitate this concept in line with the principle of efficiency as a guarantee of the Social Rule of Law, taking as a reference the approach taken since the late 1990s, based on constitutional jurisprudence on the right to die with dignity.

    El derecho a la educación en conflicto con el derecho a la seguridad ciudadana: Un análisis desde el test de ponderación del caso del colegio Marco Fidel Suárez en el Municipio de Manizales-Caldas

    This monograph presents a dogmatic-jurisprudential legal analysis of the tension between the fundamental right to education and the right to citizen security in Colombia, using as a case study the conversion of Colegio Marco Fidel Suarez in Manizales into a Protección Transfer Center (CTP) since 2018. Based on constitutional foundations, international treaties, and relevant jurisprudence, it applies the Constitutional Court’s balancing test to assess the legitimacy of this administrative decision. The study concludes that the municipal administrativos action was regressive, desproporciónate, and inconsistente with Colombia’s constitucional block, as it undermined a highly protected right —education for children and adolescents— in favor of a questionable interpretation of public security. This case exemplifies administrative violence and the violation of the principle of progressivity. The research recommends strengthening human rights-based public policies to ensure that security measures never override the best interests of the child. K

    El falso testimonio: Brechas jurídicas y su impacto a los derechos humanos en el sistema Nacional e Interamericano.

    The text reflects on the problems generated by perjury in the national and international judicial spheres, highlighting its impact on human rights at the inter-American level and the legal difficulties in addressing it. In Colombia, perjury is punishable under criminal law, but its application is limited to the national territory, and an investigation can only be initiated through extraterritoriality or a special request from the Attorney General. This is only possible if the offender is present within the national territory. At the international level, the European Court of Human Rights implicitly mentions perjury in the European Convention on Human Rights, but does not sanction or punish it in any way. In the Americas, the Inter-American Court of Human Rights (IACHR), in its rules of procedure, only requires informing national states about perjury and does not establish any mechanism for addressing or imposing any sanctions. The impact of perjury is ultimately evident in the human rights to justice and truth, generating the need for a national and international debate to address legal gaps and thus guarantee effective protection of human rights through the proper administration of justice by the Inter-American Courts. Finally, we will examine cases within the Inter-American regional system where human rights were violated, or where there was revictimization and even impunity for individuals or nations as a result of perjury.

    Afrofeminismo como constructo base al planteamiento de los derechos humanos sn Colombia: Procesos de construcción identitaria y reconocimiento de la dignidad humana

    This research analyzes how the conceptual construction of Afrofeminism contributes fundamental elements to the human rights approach in Colombia, with special emphasis on identity construction processes and recognition of human dignity. Through a qualitative methodology based on comprehensive documentary review, the evolution of the Colombian Afrofeminist movement as a constructor of self-recognition processes and validation of Afro- descendant people in their inherent dignity is examined. The study reveals that Afrofeminism constitutes an innovative construct that expands the conceptual basis of human rights by incorporating specific strategies of resistance, identity construction, and mutual recognition. Findings demonstrate that this approach develops methodologies of humanization that transcend traditional rights categories, proposing new ways of understanding dignity from intersectionality.

    La afectación del derecho a la salud por el confinamiento y desplazamiento de la población en los municipios de Nóvita y Medio San Juan.

    This study analyzes the violations of the fundamental right to health suffered by Afro-descendant and Indigenous communities in Nóvita and Medio San Juan (Chocó) during the confinements and forced displacements of 2020-2024. Using a qualitative hermeneutic-legal approach, the study triangulates normative analyses, a review of humanitarian sources, and interviews with medical personnel and community leaders to identify how the territorial control of armed actors disrupts healthcare provision, exacerbates food insecurity, and intensifies physical and psychosocial impacts. The findings show a continued deterioration of primary care services, blockades of health brigades, interruption of chronic treatments, and an increase in malaria and mental health disorders. Although local resilience strategies and community surveillance networks are evident, gaps in infrastructure and protection persist that the State has not addressed. The main limitations stem from low statistical and epidemiological data collection, as well as the difficulty of accessing disputed areas. The study concludes that reversing the crisis requires safe environments, the development of local talent, and effective policies. of progressivity with effective community participation, the only way to restore a right systematically eroded by violence and historical state neglect.

    Efectividad en los servicios que ofrecen entidades del Sistema Nacional de Atención y Reparación Integral a Victimas (SNARIV) en el Municipio de Quibdó

    This article examines the implementation of the National System of Comprehensive Attention and Reparation for Victims (SNARIV) in Quibdó, Chocó, using a theoretical framework that includes transitional justice, multilevel governance, and comprehensive reparation. It also draws on recent empirical evidence (2023–2025). Four fundamental aspects are analyzed: the timeliness and efficiency in the management of requests and procedures, the quality and relevance of attention according to victimization profiles, perceptions of institutional effectiveness, and the access to and availability of institutional services. The results indicate that, despite having a solid normative framework and formal progress, structural gaps continue to restrict differentiated attention, effective access, and meaningful participation of victims. Additional barriers faced by women, indigenous and Afro-descendant communities, and individuals with disabilities highlight the importance of improving inter-institutional coordination, the cultural relevance of reparation, and the operational effectiveness of the system. This study provides recommendations to enhance the implementation of SNARIV in highly vulnerable contexts, helping to understand the gap between public policy and territorial reality.     Violencia simbólica y la pérdida del significado de los derechos humanos en Colombia

    This document analyzes the phenomenon of symbolic violence from a critical and multidimensional perspective, recognizing its conceptual complexity and the need to overcome reductionist positions. Based on a theoretical framework proposed primarily by Galtung and Bourdieu, the text problematizes naturalistic conceptions and proposes an understanding of violence as a social, historical, and symbolic construction. The methodology adopted is qualitative, with a theoretical and documentary approach based on a critical review of classical and contemporary authors and compared with an analysis of the Colombian context using data from official entities, non-governmental organizations, and situated examples. This contrast allows for the articulation of basic concepts and the concrete situations that objectify them as structural and symbolic violence, especially in settings such as school, home, and work, where power relations tend to be normalized. The text concludes, first, that symbolic violence, by presenting itself as part of common sense, weakens the social fabric and, because it is considered legitimate, perpetuates inequalities without generating resistance. Secondly, in the Colombian case, this form of violence coexists with direct violence stemming from the armed conflict, normalizing practices that violate rights. This paper invites us to make these dynamics visible as a necessary condition for advancing the construction of a culture of peace, recognizing that overcoming violence requires transforming not only structures but also their symbolic foundations.

    Los riesgos que enfrentan los migrantes por el paso en el Tapón del Darién

    Irregular migration is one of the most complex phenomena of the 21st century, and in Latin America it has a critical transit point toward North America in the Darién jungle. This territory, located between Colombia and Panama, has become a strategic corridor for human mobility, but also a setting of severe humanitarian risks, human rights violations, human trafficking, and environmental degradation. The geographic isolation and high biodiversity of the Darién have facilitated irregular migrant transit and the operation of criminal networks, generating a humanitarian and ecological crisis. Figures reveal the magnitude of the problem: thousands of people cross the jungle each year, with a significant number of deaths and disappearances, demonstrating the insufficiency of existing protection measures. In addition, the migratory profile has changed, with a notable increase in Venezuelan migrants in recent years. The journey involves extreme risks, such as violence, sexual abuse, disease, and extortion, particularly affecting women and children. At the same time, human trafficking has become a recurring practice in the region. The environmental impact of massive transit is also considerable, including deforestation and ecosystem degradation that affect Indigenous and rural communities. In light of this situation, the text highlights the need for a comprehensive approach that integrates human rights, environmental conservation, and regional security through international cooperation and effective public policies. Finally, the work is organized into two chapters: one devoted to the analysis of irregular migration and human trafficking in the Darién, and another focused on the responses of Colombia and Panama, in order to assess their effectiveness and propose improvements in institutional coordination and migrant protection.

    Prevención del trabajo infantil en el relevo generacional para la conservación del paisaje cultural cafetero

    This research focuses primarily on the need to prevent child labor in the rural coffee-growing sector of the Quindío department, considering the importance of children and adolescents' participation in the conservation of the Coffee Cultural Landscape, a UNESCO World Heritage Site. The article argues for the need to transmit coffee culture while respecting the rights and guarantees of children and adolescents in the region, thus preventing potential human rights violations in the practical execution of coffee farming activities. It explains that, in the rural sector, informal work reaches figures exceeding 80%, increasing the risk of exploitation and, consequently, physical and psychological harm, as well as the precariousness of children's and adolescents' rights. It also highlights that the conservation of the Coffee Cultural Landscape depends largely on the transmission of knowledge from one generation to the next, as this cultural heritage is being threatened by factors such as the aging of producers and youth migration, which jeopardize the coffee-growing cultural legacy. In conclusion, the conservation of the Coffee Cultural Landscape requires mechanisms that articulate not only legal practices, but also those of preservation and belonging, in a balanced way, in order to achieve, among institutions, families and the community in general, the maintenance and preservation of this identity for the years to come.

    Eficacia de la norma de prevención del reclutamiento forzado de menores posterior a la firma del acuerdo de paz

    This research reviews the effectiveness of Colombian regulations in preventing the recruitment of minors in the post-Final Peace Agreement context. Although there is a robust legal framework at the national and international levels, the practice of recruitment continues in various regions of the country, disproportionately affecting vulnerable communities. The study is based on an analysis of the international normative framework, which encompasses instruments such as the Rome Statute, the ILO Conventions, and the Paris Principles, as well as the national context, led by the 1991 Constitution, the Childhood and Adolescence Code, and public policies such as Conpes 3673 of 2010. These provisions establish the full safeguarding of children, explicitly prohibiting their involvement in armed conflicts. However, an empirical evaluation of official information from the JEP, CNMH, Defensoría del Pueblo, and ICBF shows that, from 2017 to 2024, recruitment practices have been carried out by actors such as FARC dissidents, the ELN, and illegal armed organized groups. The persistence of this phenomenon is linked to structural circumstances: poverty, lack of governance in rural areas, illegal economies, and institutional vulnerability, which hinder the effective implementation of regulations. From a legal perspective, it follows that the effectiveness of norms is not limited to formal compliance but must achieve the social purpose for which they were established: eliminating compulsory recruitment. In this context, although the rules are valid and in force, they have not managed to significantly change social reality. Finally, suggestions are proposed to strengthen public policy, institutional coordination, and international cooperation. A strategic proposal involves considering the establishment of an office of the International Criminal Court in Colombia, with the aim of strengthening investigation, justice, and prosecution capabilities in relation to this crime, which constitutes a severe violation of human rights.

    This article seeks to reflect on the human rights challenges in the regulation of the activity of female prostitution in the context of the municipality of Calamar, Guaviare, in the last decade. To this end, a legal and regulatory analysis of the public policies that are developed in relation to sex work in Colombia is carried out. In the same sense, the principles of human rights are interpreted as a source of doctrine to seek regulatory mechanisms that allow the guarantee, protection and non-violation of the rights of those who exercise this activity in conditions of state absence. Methodologically, an exhaustive bibliographic and documentary review of the main categories of this study is proposed, which are interpreted with the support of secondary sources used in the fieldwork and in the interviews. Finally, the relationship between human rights, public health, sex work and female prostitution is accounted for, in order to propose legal alternatives that vindicate the human dignity of the population impacted by this social phenomenon.

    A reflection on the right to protest in the context of the social outbreak of 2021 in the municipality of Villavicencio is presented, in which a dogmatic-legal study is used that includes data collection, analysis of documentaries, consultation of bibliographic sources that include jurisprudence, legal doctrine, interviews, videos and scientific articles. The sources are analyzed in the context of the human rights violations that occurred during the social unrest from April 28 to June 15, 2021.

    This study focuses on analyzing the main barriers faced by residents of Villavicencio Municipality in accessing mental health services, using a case study approach. It has characterized the perceptions of current and potential users of these services, reviewed local and national policies affecting their provision, and interpreted the results to identify critical areas requiring improvement. Employing an interpretative paradigm and qualitative design, techniques such as in-depth interviews, participant observation, and case analysis were utilized. This has enabled an understanding of how environmental factors influence participants' experiences and capturing the complexity of the studied phenomena. It is concluded that residents of Villavicencio face multiple barriers to accessing specialized mental health care, including geographical, economic, and cultural limitations. Current policies exhibit significant deficiencies in coverage and financial support, highlighting the urgent need for reforms to enhance the quality and accessibility of services. Despite efforts by mental health personnel, challenges persist in the consistency and quality of service.

    In Colombia, the regulatory development on cybersex crimes against children and adolescents is limited. This deficiency imposes a disproportionate burden on the families of victims, requiring not only the collection of evidentiary material, but also additional efforts to identify and prosecute the aggressor. The lack of effective mechanisms underscores the urgency of strengthening the regulatory framework and investigative strategies to ensure an effective institutional response and comprehensive protection of children from sexual cybercrime. In order to evaluate the effectiveness of the regulations governing cyber sexual crimes against children in Colombia, a regulatory analysis is carried out aimed at identifying the existing legal gaps in relation to behaviors such as grooming, sexting, child pornography and cyber sexual harassment. Although in Colombia there are laws that punish certain sexual crimes, there are still important legislative gaps that show the need for a specific regulatory development to address these cases. This situation also highlights the urgency of adopting effective public policies to strengthen strategies for prevention, mitigation and identification of risks to which children and adolescents are exposed in the digital environment.
